How a civil claim works

Most matters begin with a letter before action setting out the claim and inviting settlement. If that does not resolve it, proceedings are started in the Parish Court or the Supreme Court depending on the value and nature of the claim. Supreme Court cases follow the Civil Procedure Rules, and many are referred to mediation before trial. We explain each stage, the likely costs and the realistic outcomes before you decide how far to go.

If you have been served with a claim form, do not ignore it. There are short deadlines for filing an acknowledgement of service and a defence, and missing them can lead to judgment being entered against you without a hearing. Contact us as soon as you receive court papers.

Which court will my case be heard in?

Smaller claims are usually heard in the Parish Court for the parish concerned, such as the St. James Parish Court in Montego Bay. Larger or more complex claims go to the Supreme Court. We advise on the right forum for your matter.

What should I do if I have been served with court papers?

Contact an attorney straight away. Court documents come with strict deadlines, and if you do not respond in time the other side may obtain judgment against you without a hearing.

Can I recover my legal costs if I win?

The court usually orders the losing party to pay a portion of the winning party's legal costs, but rarely the full amount. We explain the likely position on costs at the start.
